COMMERCIAL
LITIGATION
Claims involving contracts, intra-corporate disputes, construction,
securities law, partnership disputes, fraud and RICO; equity matters
including claims for specific performance and injunctions.
The following are examples of our
representation in this practice area:
Sprague & Sprague successfully represented a prominent professor and
research scientist whose contract and academic freedom were violated by a
university and several of its top administrators. The Firm secured a
multi-million dollar recovery for our client, following a trial and
appeals through Pennsylvania’s state courts.
The Firm successfully represented one of the world’s largest passenger
rail car manufacturers in halting the improper award to a competitor of a
$250 million public transportation agency contract, where we advanced
various objections to the agency’s procurement process.
We successfully defended the owners of communication towers in a
multi-million dollar breach of contract claim seeking a portion of the
proceeds from the sale of those towers. We secured summary judgment for
our clients, without the necessity of a trial, which judgment was
subsequently upheld by the Superior Court of Pennsylvania.
When a major car dealer purchased an existing property lease and the
municipal landlord refused for political and other improper reasons to
provide its necessary consent, Sprague & Sprague successfully sued on
the dealer’s behalf, achieving a complete victory through a settlement
at trial that secured both the City’s approval and an extension of the
term of the existing lease.
The Firm successfully represented an estate in its claims against a
managing partner of a family partnership, resulting in a favorable and
often-cited opinion of a federal court of appeals which allowed our client
to proceed against the managing partner, and others, under RICO.
We obtained unprecedented injunctive relief for a prominent law firm that
prevented a departing partner from ignoring the contractual duties and
obligations he owed to his fellow partners. |
